Community Legal Clinic - Brant, Haldimand, Norfolk Yes, tenants can be evicted in the winter months. However, a landlord has to have a legal reason for the eviction and must follow a clearly defined process. The permitted reasons and the process are set out in the Residential Tenancies Act (the RTA), the law that applies to tenancies in Ontario. The RTA sets out fundamental aspects of any tenancy agreement between a landlord and tenant, whether the agreement is written or oral. Any disputes that arise (such as eviction or repairs) can be resolved by applying to the Landlord and Tenant Board (the LTB). A sole proprietorship refers to an individual who owns a business in his/ her personal name, or operates through a trade name. The business income is considered the same as the owner's personal income for tax purposes and are both included in an individual's tax return. Business expenses and losses are deductible and a proprietor is personally responsible for all debts or liabilities of the business. A corporation is a separate legal entity.
